Data recorded in Judge FOOTE's "Historical Papers,(VII,130) states that Joseph LOUCKS appeared before Judge Matthew Prendergast 5 May 1818 to apply for a pension under the terms of the Act of 1818. He was 63 years 2 months 13 days old at that date. The PAF date calculater gives 22 Feb 1755 as his birth date. He signed his name as Jost Laux at that time. His birthdate is shown as 1754 on his tombstone and 22 Feb 1754 on the Michael Rose Record. !Joseph Loucks appeared before Judge Matthew Prendergast 5 May 1818 to apply for a pension under the terms of the Act of 1818. In the declaration of his wartime service he listed four terms of enlistment. He enlisted, first in March 1776 in Capt. Andrew Finch's Company in Col. Peter Gansevoort's Regiment (3rd New York Continental Line) to serve 10 months. He was stationed nearly the whole of this time, he stated, at Fort George and was discharged at Albany on 1 Jan. 1777. His 2nd enlistment began shortly afterwards, in the winter of 1777, as an enlisted man in the Company of Capt. Christian House in the 2nd Regiment of the Tryon County Militia. He spent nearly all the year 1777 on active duty in this company and regiment. During this enlistment he participated in the battle of Oriskany 6 Aug. 1777. His third tour of service began in March 1778 as a boatman in Captain Peterson's Company engaged in carrying provisions from Schenectady to Rome up the Mohawk River. This tour of service lasted for 10 months, ending with discharge at Schenectady 1 Jan. 1779. His fourth and final term of service was in the ranks of Col. Marinus Willet's special task force organized to break the power of the Tory and Indian forces in the Mohawk valley. During this enlistment he participated in the battle at Johnstown, New York, 25 Oct. 1781. Joseph signed this affidavit Jost Laux. His pension was denied because he failed to keep his discharge papers. !He and his wife and 5 of their children c ame to Chautauqua County from Cazenovia, Madison County, New York in 1814. in Sept. of that year he purchased Lots #11 and #12, Twp 2, Range 12, in the southeastern section of Ellery Twp. The five children that came with him at this time were John, Daniel, Hiriam, Margaret and Polly. Later his older sons Joseph, Henry, Peter, David and Charity came to live on the 200 acres that he had purchased. This area was known as Loucks Hollow for a while and is still called Dutch Hollow for the German word Deutsche, which is German for German.

      Loucks genealogy book is incorrect starting with the 3rd generation on page 17, stating that Joseph's birth date and year as 1756. It then incorrectly lists his parents as John Adam Loucks and Catherine Snell as the second generation. Correct parents are Joseph Loucks and Margretha Mabie.

      There are two men named “Joseph Loucks/Laux” christened approximately two years apart at the Dutch Reformed Church in Stone Arabia, NY.

      Both men were called/nicknamed “JOOST” or “JOST” in their records. They are VERY COMMONLY confused with each other.

      Likewise, it is well-documented that JOOST2
      sided with the Tory Loyalists during the Revolutionary War and eventually moved to Canada (Ontario) after the war. All of his children were born in Ontario, Canada. Both he and his wife Anna died and were buried in Canada.

      It is well-documented that JOOST1 was a Revolutionary Patriot who ended up residing in New York after the Revolutionary War. All of his children were born in New York. Both he and his wife Margretha died and were buried in upper New York state.

      There are big discrepancies in the Edwin Merton McBrier book (especially on pp.16-17) which states that McBrier’s JOOST
      — was born 09 Dec 1756 (JOOST2=correct)
      — died in 1798 (JOOST2=incorrect)
      — died in Oppenheim, NY (JOOST2=correct, he died in 1825–see headstone photo in FamilySearch Memories tab above)
      — married Margretha Mabie, in 1780 (JOOST2=correct, name & marriage year are correct).

      From my research on Edwin Merton McBrier, his wife’s maiden name was Carrie Loucks [ID# K84T-37D ]), and on p.17 he indicates that his wife’s JOOST relative was a Revolutionary Patriot. So I deduce that “his” JOOST is indeed intended to be JOOST2, the JOOST who settled in New York after the War. My assumption is correct that McBrier must have mistakenly gathered the death demographics of the wrong JOOST. But fortunately McBrier did indeed get JOOST2’s wife’s name (Margretha Mabie) correct on p.16-17, because she was indeed born and passed away in New York. And most of JOOST2’s children were born & raised in New York.

      We can further deduce that JOOST2 is the NY Loucks family intended for McBrier’s book. Therefore, JOOST1 and family migrated to Canada with his family during or following the Revolutionary War.

      BOTH gentlemen have similar names and were christened two years apart in the same Reformed Dutch Church in Stone Arabia, NY. Yet they both led very dissimilar lives and ended up on two opposing sides of a very pivotal war that decided the futures of their home countries.

      If you look at the Ancestry image showing the handwritten record in the Dutch Church's 1754 baptism record, the boy's name is John Jost whose parents are John Gerrit (?) Laux and Gertrud Deuger. Ancestry indexed last name wrong: Lana

      John may have used the Joseph later in life, but he was baptized John. Johann was a German name for John.

      The cousins named Joseph
      Note: This Joseph and his cousin Joseph FS # GQ5X-6TF are only 2 years apart. I believe the records are getting mixed up. Each show different parents through baptisms. I recently found a source to link Joseph #242T-FBM in a marriage record with a 1756 birth year. I also found a Dutch church record with this birth year listing the parents to be Adam Laux and Catrinlis Laux. I believe we need more sources uploaded to clear up the confusion.
